Giveaway Details and Privacy

1. Who is eligible to enter giveaway?

  • No purchase necessary to win. Purchase or payment of any kind will not increase odds of winning.
  • Whole Foods Market + Take Two Foods Giveaway is open only to legal residents of the 50 United States, including District of Columbia, who are at least 18 years old at the time of entry.
  • Employees of Whole Food Markets, Take Two Foods and FINEX Cast Iron Cookware and its subsidiary and affiliates, as well as employees’ immediate family members (spouse, parents, siblings, and children), are not eligible to win.
  • One entry per person allowed.

2. How to enter?

  • The duration of the giveaway is January 6- February 3, 2021.
  • Four winners will be chosen at random and announced the first week of February 2021.
  • Winners will each receive a giveaway prize bundle including: $250 gift card to Whole Foods Market (redeemable at all Whole Foods Markets in the U.S. and/or online on Amazon Prime); 4-pack of Take Two Barleymilk; Take Two swag box; and 1 FINEX Cast Iron Cookware pan chosen by Take Two Foods.
  • Entries are accepted via entry form at https://www.taketwofoods.com/whole-foods-market-giveaway
  • Multiple entrants are not permitted to share the same email address and/or household. Any attempt by any entrant to obtain more than the stated number of entries by using multiple/different email addresses, identities, registrations, log-ins, and/or any other methods will void that entrant’s entries and that entrant may be disqualified. Use of any automated system to participate is prohibited and will result in disqualification. Sponsors are not responsible for lost, late, incomplete, invalid, unintelligible, or misdirected registrations, which will be disqualified.
  • The number of eligible entries received and total prizes available determines the odds of winning.

3. How are winners chosen?

  • Winners must comply with all terms and conditions of these official rules, and winning is contingent upon fulfilling all requirements.
  • Winners will be notified by email at the end of the giveaway duration period.
  • If a potential winner cannot be contacted, fails to reply to the notification email within the required time period of two weeks, or any prize is returned as undeliverable, potential winner forfeits prize.
  • In the event that a prize winner is disqualified for any reason, the prize will be awarded to an alternate winner selected at random.
  • All prizes are non-transferable and no substitutions will be made, except as provided herein by the administrator’s (Take Two Foods) and/or sponsor’s (Whole Foods Market) discretion. Administrator and sponsor reserve the right to substitute a prize for one of equal or greater value if the designated prize should become unavailable for any reason.
  • By receipt of any prize, winner agrees to release and hold harmless Whole Foods Market, sponsor, and their respective subsidiaries, affiliates, suppliers, distributors, advertising/promotion agencies, and each of their respective parent companies and each such company’s officers, directors, employees and agents {collectively, the “Released Parties”} from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property, arising out of participation in the giveaway or receipt or use or misuse of any prize.

4. Other giveaway information

  • Take Two, administrator, reserves the right to cancel, suspend and/or modify the giveaway, or any part of it, if any fraud, technical failures or any other factor beyond administrator’s reasonable control impairs the integrity or proper functioning of the giveaway. In such an event, administrators reserve the right to award the prizes at random from among the eligible entries received up to the time of the impairment.
  • Whole Foods Market sponsors the giveaway but does not actually give anything away or mail any prizes. Take Two Foods, administrator, is directly responsible for providing the prize, therefore, Whole Foods Market cannot be held responsible for any prize that is not received. Any issues involving the shipment, delivery, receipt, or quantity/quality/etc. of prizes must be taken up with Take Two Foods, administrator.
  • The released parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors. or by any of the equipment or programming associated with or utilized in the giveaway; (2) technical failures of any kind; (3) unauthorized human intervention in any part of the entry process or the giveaway; (4) technical or human error which may occur in the administration of the giveaway or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the giveaway or receipt or use or misuse of any prize.
  • No more than the stated number of prizes will be awarded.
  • Participation constitutes entrant’s full and unconditional agreement to these Official Rules and administrator’s and sponsor’s decisions, which are final and binding in all matters related to the giveaway. Winning a prize is contingent upon fulfilling all requirements set forth herein.
  • Void where prohibited by law.

5. Security of data

We or our third-party providers use a variety of security measures, including encryption and authentication tools, to help protect your information. All credit card information you supply is transmitted via secure servers and Secure Socket Layer (SSL) technology and stored with an AES-256 encryption.

We take commercially reasonable precautions and have implemented commercially reasonable technical measures to protect against the risks of unauthorized access to, erroneous disclosure of, and unlawful interception of personal information submitted via the website or otherwise collected or possessed by us. However, the Internet is never 100% secure and we do not guarantee the security of any information transmitted over the Internet. For the avoidance of doubt, we expressly disclaim any representation or warranty, whether express or implied, with respect to ensuring, guaranteeing or otherwise offering any definitive promise of security in connection with your information.

We collect this information for the purposes described in section 2. As described above in section 3 we also share and/or disclose your personal information as follows:

  • Sharing your personal information for business purposes: we may share the following categories of your personal information with service providers, third parties, business partners, public or government (including enforcement) authorities, creditors, and successors for our business purposes: identifiers, information capable of being associated with you, information about products and services, internet or other electronic activity information (as described above), and inferences drawn from information about you. As described above, examples of business purposes include performing transactions, registering accounts, managing our relationship with you, and monitoring for security threats and fraud.
